Welcome to GRADELEVEL. These Terms of Service ("Terms") govern your use of the GRADELEVEL app and website (collectively, the "Service"). By creating an account or using GRADELEVEL, you agree to these Terms.
Please read them carefully. If you do not agree, do not use GRADELEVEL.
1. About GRADELEVEL
GRADELEVEL is an educational reference app that translates California K–5 academic standards into plain, parent-friendly language. It is operated by Judy Kozina, based in Lodi, California.
GRADELEVEL is designed to help parents and guardians understand what their child is expected to learn at each grade level. It is a reference and support tool — not a substitute for your child's school, teacher, or school district.
2. Eligibility
To use GRADELEVEL, you must:
- Be at least 18 years old
- Be a parent, guardian, or educator of a child in Kindergarten through 5th grade
- Provide accurate and truthful information when creating your account
- Agree to these Terms and our Privacy Policy
GRADELEVEL is not intended for use directly by children. By creating an account, you confirm that you are an adult creating and managing the account on behalf of your family.
3. Your Account
3a. Creating an Account
To access certain features (such as saving your progress), you must create a free account using a valid email address and password. You are responsible for keeping your login credentials secure.
3b. Account Responsibility
You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at gradelevelcustomerservice@gmail.com. We are not liable for losses caused by unauthorized use of your account.
3c. One Account Per Person
Each person may maintain only one GRADELEVEL account. Creating multiple accounts to circumvent restrictions is prohibited.
4. Free and Paid Plans
4a. Free Plan
GRADELEVEL offers a free tier that includes access to standards content for selected grade levels. Free plan features may change at any time with reasonable notice.
4b. Paid Subscription
GRADELEVEL may offer premium subscription plans that unlock additional grades, features, or content. Subscription details, pricing, and billing terms will be clearly disclosed before you purchase.
- Subscriptions are billed on a recurring basis (monthly or annual) unless cancelled.
- You may cancel your subscription at any time from your account settings.
- Cancellation takes effect at the end of the current billing period. You will retain access until then.
- We do not offer refunds for partial billing periods, except where required by law.
4c. Price Changes
We may change subscription prices at any time. We will give you at least 30 days' notice before any price increase takes effect, giving you the opportunity to cancel before the new price applies.
4d. Payment Processing
Payments are processed securely by Stripe. By providing payment information, you authorize us to charge your payment method for your subscription fees. You agree to Stripe's terms of service at stripe.com/legal.
5. Acceptable Use
By using GRADELEVEL, you agree NOT to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Share your account credentials with others
- Attempt to access, tamper with, or disrupt our systems, databases, or servers
- Scrape, copy, reproduce, or redistribute GRADELEVEL content without our written permission
- Impersonate another person or entity
- Upload or transmit harmful, offensive, or inappropriate content
- Attempt to reverse-engineer, decompile, or extract our source code
- Use the Service to compete with GRADELEVEL commercially without our written consent
We reserve the right to suspend or terminate accounts that violate these terms, at our sole discretion.
6. Intellectual Property
6a. Our Content
All content in GRADELEVEL — including the parent-friendly standards explanations, 'Try it at home' tips, games, design, graphics, and code — is owned by Judy Kozina and protected by copyright and other intellectual property laws.
You may use GRADELEVEL content for your personal, non-commercial use as a parent or educator. You may not reproduce, distribute, sell, or create derivative works from our content without written permission.
6b. California State Standards
The underlying California academic standards referenced in GRADELEVEL are public documents published by the California Department of Education. Our plain-language interpretations, explanations, and educational tips are our original creative work.
6c. Your Content
You retain ownership of any content you create or input into GRADELEVEL (such as notes or custom entries, if applicable). By submitting content, you grant us a limited license to store and display it as part of providing the Service.
7. Educational Disclaimer
GRADELEVEL is an informational reference tool. While we work hard to accurately represent California K–5 academic standards, we make no guarantees regarding:
- The completeness or accuracy of our standards interpretations
- Specific outcomes for any individual child
- Alignment with any specific school, district, or curriculum
California academic standards may be updated by the California Department of Education. While we strive to keep GRADELEVEL current, there may be a delay between standard updates and our content updates. GRADELEVEL is not affiliated with, endorsed by, or partnered with the California Department of Education, any school district, or any school.
8. Limitation of Liability
To the fullest extent permitted by law:
- GRADELEVEL is provided 'as is' without warranties of any kind, express or implied.
- We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of GRADELEVEL.
- Our total liability to you for any claims arising from these Terms or your use of GRADELEVEL shall not exceed the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless GRADELEVEL and Judy Kozina from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Termination
10a. By You
You may stop using GRADELEVEL and delete your account at any time from your account settings or by contacting us at gradelevelcustomerservice@gmail.com.
10b. By Us
We reserve the right to suspend or terminate your account and access to GRADELEVEL at any time, with or without notice, for any reason including — but not limited to — violation of these Terms, non-payment, or conduct that we determine is harmful to other users or the Service.
10c. Effect of Termination
Upon termination, your right to use GRADELEVEL ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will survive.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by posting a notice in the app at least 14 days before the changes take effect.
Your continued use of GRADELEVEL after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the new Terms, you must stop using GRADELEVEL before they take effect.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of GRADELEVEL shall be resolved in the state or federal courts located in San Joaquin County, California.
Before filing any legal claim, you agree to contact us at gradelevelcustomerservice@gmail.com and give us 30 days to attempt to resolve the issue informally.
13. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GRADELEVEL regarding the Service.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
